Medicare Advantage Balance Billing Class Action Recently Filed:

 

On May 20, 2014, AzTLA members Geoff Trachtenberg and D. Lance  Entrekin filed a Medicare Advantage balance billing class action Complaint, Aycock et al v. Scottsdale Healthcare Corp., Dignity Health, and John C. Lincoln Health Network, Maricopa County Superior Court, CV-006892. CV2014-006892  Meanwhile, hospitals continue to file A.R.S. §33-931 et seq Medicare Advantage balance billing liens against personal injury and medical malpractice liability settlements. The basis of why all healthcare providers may not utilize A.R.S. §33-931 et seq balance billing liens is that federal Medicare and Medicaid statutes and regulations prohibit such balance billing and that this federal scheme preempts Arizona law including A.R.S. §33-931 et seq.
