WARNING: AHCCCS Liens:

 

As discussed in past articles, when practical get your personal injury & medical malpractice cases with AHCCCS liens settled and Ahlborn lien reduction requests into AHCCCS PRIOR TO OCTOBER 1, 2017. On October 1, 2017, the Bipartisan Budget Act of 2013, §202(b)(1)(B)  effectively eliminates the U.S. Supreme Court holdings [in Ark. Dept. of Health and Human Services v. Ahlborn, 547 U.S. 268, 126 S.Ct. 1752 (2006) and Wos v. E.M.A., 548 U.S. ___, 133 S.Ct. 1391 (2013)] requiring AHCCCS to pro-rata reduce lien claims equitably based on the amount recovered divided by the cases’s “full value”.

[Added Note: Be sure to contend that  Ahlborn applies to all medical expenses/benefits incurred with date of service prior to October 1, 2017.)
