2017-11/12: ALJ Decision Medicare Wrongful Death Lien

Recent ALJ Decisions That Medicare Liens Do Not Apply Against Arizona Wrongful Death Settlements:

 

There have been two recent ALJ (Administrative Law Judge) Appeals, Appellant T. Hall, No.

1-6586243175 (October 26, 2017) (AAJ/AzTLA Member Justin Henry), and Appellant B. Kowalski, No. 1-4756973072 (November 10, 2016) (AAJ/AzTLA Member Steven J. Bruzonsky) which have held that Wrongful Death settlement proceeds paid to the Appellant’s surviving statutory beneficiaries are not subject to Medicare’s lien for conditional payments. In both cases the attorneys’ contingent fee agreements and correspondence with and from the auto insurance carriers made it clear that the attorneys represented and collected only damages for the surviving Wrongful Death beneficiaries and did not claim or collect anything for the decedents’ medical expenses.
