Updates On Various Types of Lien Issues

 

Amended ER 1.15:Thanks to the hard work of AAJ/AzTLA members Geoff Trachtenberg, Tom Ryan, Dave Abney and others, Arizona is the very first jurisdiction in our country to have such a well thought out and fair and reasonable amendment to our Ethical Rules regarding the attorney’s ethical responsibilities vis-à-vis liens. Keep in mind the amended ER 1.15, effective as of January 1, 2014 AND that compliance with the rule may protect the attorney in the case of an Ethics complaint, but that the amended ER 1.15 does not protect the attorney and client (or tortfeasor) from the lien claimant filing a lawsuit regarding the lien.
