Lien Avoidance and/or Reduction

Following are just a few recent examples of how Attorney Bruzonsky has avoided paying or negotiated substantial reductions in Lien or reimbursement claims:

  1. Hospital statutory (A.R.S. § 33-931 et seq) balance billing lien claim of more than $460,000 after payment by health insurance. Attorney Bruzonsky prepared a lengthy and detailed Declaratory Judgment lawsuit. The hospital, through its attorneys, waived its entire balance billing lien claim and filed a Lien Release. The patient was required to pay the small copay/deductible per patient’s health insurance contract.

  2. Hospital Medicare balance billing lien claim of more than $80,000. Hospital had elected, as permitted by Medicare regulations, to bill the injury settlement instead of billing Medicare. Hospital persuaded to bill Medicare although this is not required. Then hospital, through its attorneys, waived entire balance billing lien claim and filed Lien Release. Patient only required to pay small Medicare copayment.

  3. Hospital statutory (A.R.S. § 33-931 et seq) lien claim of almost $200,000. More than three years post-accident, and after the case was settled, Attorney Bruzonsky was retained to resolve the hospital lien claim. The hospital had found no health insurance and elected to bill the injury settlement. Attorney Bruzonsky found applicable health insurance and persuaded the hospital, through its attorneys, to bill and get paid by health insurance. After payment by health insurance, the hospital had a remaining statutory (A.R.S. § 33-931 et seq) balance billing lien claim of about $80,000. Attorney Bruzonsky prepared a detailed Declaratory Judgment lawsuit and recommended that the primary attorney file the lawsuit unless the hospital compromised its remaining balance billing lien claim by a very large percentage, which is what was done.

  4. Employer healthplan lien claims sometimes substantially reduced, sometimes waived, using various legal arguments.
